This event runs from 15 May 2025 to 22 July 2025, offering guests a unique fondue dining opportunity in an open-air public setting. By making a reservation, purchasing a ticket, or attending Fondue Chalet, you (the “Guest” or “You”) agree to be bound by these Terms and Conditions (“Terms”). These Terms outline the policies governing reservations, payments, attendance, safety, and legal responsibilities to ensure a safe, enjoyable, and seamless experience. Please review them thoroughly before participating.

1. Introduction

Fondue Chalet is owned and operated by BBR Group Australia (ABN 93 121 083 805) (“We”, “Us”, or “Our”), a company committed to delivering exceptional dining experiences. Located within the Fed Square precinct, this event operates under a permit from Fed Square management and adheres to both our policies and the venue’s overarching regulations.

Your participation, whether booking a table, attending as a walk-in, or purchasing add-ons, binds you to these Terms. Additional conditions may also apply, including Venue Terms, which are Fed Square’s precinct-wide rules available on the Fed Square website (www.fedsquare.com) and take precedence in case of conflict; Event-Specific Terms, which are supplementary conditions for particular dates, menus, or promotions detailed at the time of booking or on our website (http://www.founduechalet.com.au); and Authorised Partners’ Terms, which are policies from third-party sellers (e.g., ticketing agents or tourism operators) applicable if you book through them. We reserve the unequivocal right to cancel bookings, refuse entry, or deny service to any individual or group for non-compliance with these Terms, Venue Terms, or for safety, operational, or behavioural reasons, at our sole discretion.

2. Reservations and Attendance

2.1 Booking Policy

Reservations are strongly recommended and can be made through our official website https://fonduechalet.com.au/ or by contacting us directly via email info@fonduechalet.com. Walk-ins are welcome but subject to availability on a first-come, first-served basis. At the time of booking, you must provide a valid contact number and email address for communication and confirmation purposes. Incomplete or inaccurate details may result in your booking being voided. A reservation is only confirmed once you receive an official confirmation email or message from Fondue Chalet. Until then, your spot is not guaranteed. We retain the absolute right to refuse entry or service to any guest or group, without prior notice or justification, based on factors such as safety concerns, operational capacity, or suspected breaches of these Terms.

2.2 Arrival and Seating

Guests are required to arrive at least 10 minutes before their scheduled reservation time to ensure smooth check-in and seating. Tables are held for a maximum of 15 minutes past the reserved time. After this grace period, we may reassign your table to other guests without obligation to accommodate you later. All seating is outdoors within Fed Square’s public precinct, exposing guests to Melbourne’s variable weather conditions (e.g., rain, wind, temperature shifts). We provide blankets where possible to enhance comfort, but these are not guaranteed. Guests are advised to dress appropriately with layers, waterproof clothing, or sun protection as needed. Table assignments are determined solely by Fondue Chalet staff, taking into account group size, availability, and operational requirements (e.g., service flow, weather impact). While we consider seating preferences, these are not binding, and final decisions rest with our team.

2.3 Cancellations and No-Shows

All bookings require a $200 deposit at the time of reservation. If you cancel your booking at any point, this deposit is forfeited and strictly non-refundable. Refund of the balance payment is possible before 10 days of your selected date of event. It is possible to change the date of your booking up to 10 days before the date of your selected session. That is, if your booking is on the 15th of May, you can edit the date of your booking by until the 4th of May 2025. Cancellations after the 10-day deadline will result in the loss of the 100% of the ticket price with no additional refund or credit provided, regardless of the reason (excluding extreme weather or external factors, see Section 6). If you fail to arrive for your reserved time without prior notification, the 100% ticket price is forfeited in full. No additional penalties will be applied, but no refunds, credits, or rescheduling options will be offered unless explicitly covered under Section 6. Cancellations are effective only upon our acknowledgment. Voicemails or unconfirmed messages do not constitute valid cancellation. In cases of extreme weather (e.g., heavy rain, storms), we evaluate cancellations or rescheduling on a case-by-case basis.

2.4 Booking Limits

To ensure fair access, we may impose restrictions on the number of bookings an individual can make for the season or specific dates. These limits will be communicated at booking if applicable. If you exceed these limits, determined by matching details such as name, email, phone number, or payment method, we reserve the right to cancel any additional bookings without prior notice or compensation.

2.5 Mistakes in Bookings

You are solely responsible for verifying all booking details, such as date, time, and number of guests, before finalising your reservation. Errors (e.g., selecting the wrong date or party size) do not entitle you to automatic refunds or exchanges unless corrected as outlined below. If you identify an error, contact us at least 10 days prior to your booked date (e.g., by 4th May 2025 for a 15 May booking). We will attempt to reschedule to an available alternative time, subject to capacity. Corrections after this period are not guaranteed, and the $200 deposit remains non-refundable per Section 2.3. We bear no responsibility for losses (e.g., travel costs) arising from booking mistakes not corrected within this timeframe.

2.6 Age Restrictions and Supervision

Guests under 12 years old must be accompanied by an adult (18 or older) at all times during the event. Children under 6 eat free with a paying adult, limited to standard menu items (e.g., core fondue dishes, excluding add-ons or specials), with no additional deposit required for their inclusion. Adults are fully responsible for the behaviour, safety, and compliance of accompanying children. If children disrupt other guests, staff, or the event experience (e.g., excessive noise, unsafe actions), we may require your entire party to leave without refund or compensation. Certain dates or experiences (e.g., adults-only nights, late-evening sessions) may impose minimum age requirements. These will be clearly stated at booking, and non-compliant guests will be denied entry without refund.

3. Payment and Pricing

3.1 Menu Pricing

All prices are quoted in Australian Dollars (AUD) and include Goods and Services Tax (GST) where applicable, ensuring transparency in billing. Menu and package prices are subject to change without prior notice due to factors like supply costs or operational adjustments. However, the price confirmed at the time of your booking will be honoured for your reservation unless we notify you otherwise. Children under 6 eat free when accompanied by a paying adult, applicable only to standard menu items (e.g., basic fondue offerings). Add-ons, beverages, or specialty items for children incur standard charges.

3.2 Payment Terms

Unless pre-paid (e.g., for Dining Packages or deposits), full payment for your dining experience is due at the conclusion of your visit, covering all food, beverages, and add-ons consumed. We accept cash, major credit and debit cards (Visa, Mastercard, Amex), and mobile payments (e.g., Apple Pay, Google Pay). A surcharge may apply to card transactions, clearly disclosed at the time of payment (e.g., 1.5% for credit cards). For groups, split billing is available if requested at the start of service. Late requests may not be accommodated due to operational constraints.

3.3 Deposits

All reservations require a $200 deposit of the total estimated cost (based on party size and standard menu pricing) at the time of booking, payable via our website or direct contact. For parties of 8 or more, or special event bookings (e.g., private functions), additional deposit conditions may apply, such as a higher percentage or earlier payment deadline. These will be detailed during the booking process. Deposits are strictly non-refundable. After this date, deposits and remaining balance are forfeited for all cancellations or no-shows, except in cases of extreme weather or external factors (see Section 6). Refunds of the balance payment, when applicable, are processed to the original payment method within 10 business days.

4. Dining Experience

4.1 Outdoor Environment

Fondue Chalet is staged in Fed Square’s open-air precinct, a public space subject to natural elements (e.g., rain, wind, heat) and ambient noise from surrounding activities (e.g., events, traffic). We provide portable heaters and blankets to mitigate cold weather, subject to availability and operational feasibility. However, we cannot guarantee protection from all weather conditions, and guests should prepare accordingly with appropriate attire (e.g., coats, hats, sunscreen).

4.2 Food and Beverage

Our menu centres on fondue-inspired dishes (e.g., cheese, chocolate) paired with beverages. Specific offerings may vary daily based on ingredient availability or chef discretion, with changes communicated at seating if applicable. Notify us of dietary requirements (e.g., vegetarian, gluten-free, allergies) at booking to ensure accommodations, subject to availability. Late notifications may not be honoured. Children under 6 eat free with a paying adult, limited to standard menu items (e.g., basic fondue and dippers). Specialty items, add-ons, or beverages for children are charged at regular rates. Bringing outside food or alcohol is strictly prohibited, except for personal water bottles or medically necessary items (e.g., baby food, allergy-safe snacks), which require prior staff approval. Violations may result in removal without refund. Alcoholic beverages are available only to guests aged 19 or older who present valid, government-issued photo ID (e.g., driver’s licence, passport). We adhere to Victorian Responsible Service of Alcohol (RSA) laws and may refuse service to intoxicated or non-compliant guests at our discretion.

4.3 Service

Our staff strive to deliver prompt, courteous service to enhance your experience. However, delays may occur due to high demand, weather disruptions, or unforeseen operational challenges. We appreciate your patience in such instances. Tipping is not mandatory in Australia but is warmly welcomed for exceptional service. Any gratuities go directly to the staff serving you.

4.4 Event Packages and Add-Ons

We may offer Dining Packages or upsell items, such as beverage pairings (e.g., wine flights), dessert upgrades, or group dining deals. These come with specific terms provided at purchase, which supplement these Terms. Fondue Chalet is accountable only for packages sold directly through us or our Authorised Partners (e.g., official ticketing agents listed on our website). If you purchase a package from a third party (e.g., tourism operator, event promoter), any issues, refunds, or queries must be directed to them, as we bear no liability for their offerings.

5. Safety and Conduct

5.1 Guest Responsibility

Guests must act respectfully toward staff, fellow diners, and Fed Square property. Disruptive, offensive, or unsafe conduct (e.g., loud arguments, throwing objects) may lead to immediate removal from the premises without refund or recourse. Adults accompanying children are wholly responsible for their actions, safety, and adherence to these Terms. Lack of supervision resulting in disruption or risk may prompt staff to ask your party to leave.

5.2 Health and Safety

We adhere to Victorian health, safety, and food handling regulations, including regular sanitation and staff training. Guests must comply with any active public health directives at the time of their visit (e.g., QR code check-ins, mask mandates), as mandated by the Victorian Government or City of Melbourne. Inform staff of allergies, intolerances, or medical conditions that could affect your dining experience (e.g., severe nut allergies, epilepsy triggered by heat). We are not liable for adverse reactions unless directly caused by our negligence or failure to act on disclosed information.

5.3 Property

Fed Square is a public cultural hub with artworks, seating, and pathways. Guests must not damage, deface, or misuse these areas during their visit. We are not responsible for loss, theft, or damage to personal items (e.g., bags, phones) brought to Fondue Chalet. Secure your possessions and report incidents to staff immediately if assistance is needed.

5.4 Event Entry and Security

We may refuse entry if your booking is cancelled, mishandled (e.g., duplicate reservations), or you fail to meet safety or security requirements (e.g., intoxication, non-compliance with checks). For everyone’s safety, you and your belongings may be subject to inspections upon arrival, including bag searches or visual checks. Refusal to consent may result in denied entry without refund or rescheduling. Fed Square’s precinct-wide entry conditions (e.g., bag size limits, event-specific rules) apply and override these Terms if conflicting. Review them at www.fedsquare.com prior to your visit.

5.5 Prohibited Items

To maintain a safe and enjoyable environment, the following are prohibited: alcohol (except that sold by Fondue Chalet), glass bottles or containers, hot food from outside sources, illicit substances (e.g., drugs), weapons (e.g., knives, firearms), flammable items (e.g., lighters, fireworks), large bags or backpacks (dimensions exceeding 40cm x 30cm x 20cm), and any item deemed by staff to pose a safety risk or annoyance (e.g., noisemakers, drones). If you bring prohibited items, you must surrender them to staff to gain entry. Surrendered items will not be stored or returned, and disposal is at our discretion. Fed Square may enforce further restrictions (e.g., no bicycles, no pets except service animals). Check their website for a complete list.

6. Weather and External Factors

6.1 Event Changes

We reserve the right to modify the Fondue Chalet experience without prior notice, including changes to menu items, seating arrangements, operating hours, or event layout. Such adjustments may stem from availability (e.g., ingredient shortages), weather conditions, or operational needs (e.g., staff scheduling). If unforeseen circumstances (e.g., venue restrictions, supply chain failures) necessitate cancellation or major changes to the event, we will notify affected guests as soon as practicable via the contact details provided at booking. Options for refunds or rescheduling will be offered at our discretion, subject to the deposit policy in Section 2.3.

6.2 Adverse Weather

As an outdoor event, Fondue Chalet persists through mild weather variations (e.g., light rain, moderate wind). We aim to operate unless conditions pose a clear safety threat to guests or staff (e.g., thunderstorms, gale-force winds). The Venue Manager has sole authority to cancel a session due to adverse weather, a decision that may be made at any time, before, during, or shortly after the scheduled start, based on real-time conditions and forecasts. Guests accept that Melbourne’s weather unpredictability may lead to last-minute calls. For cancellations due to adverse weather, we issue vouchers equivalent to your booking value, redeemable for a future session within the 2025 season (15 May to 22 July), subject to availability. Vouchers are emailed to the address provided at booking, with instructions for reuse. Dissatisfaction with weather (e.g., deeming it too cold or damp) does not warrant refunds or vouchers unless we officially cancel the session. If a weather-related cancellation occurs between 15 July and 22 July 2025 (the season’s last week), and rescheduling within the season is impossible, contact us at info@fonduechalet.com.au with your booking reference within 14 days of cancellation.

6.3 External Factors

External factors include events beyond our control, such as government mandates (e.g., public health restrictions), Fed Square directives (e.g., precinct closure), or emergencies (e.g., power outages, natural disasters). These may force us to reduce capacity, alter layouts, or cancel sessions entirely. We will determine the response, e.g., reallocating bookings, issuing credits, at our absolute discretion, prioritising safety and compliance. If your booking is cancelled due to external factors, you receive a full refund, including the $200 deposit, processed within 10 business days.

7. Risk and Liability

7.1 Guest Responsibility

Dining at Fondue Chalet is at your own risk. You must wear appropriate clothing and footwear for an outdoor setting (e.g., closed-toe shoes, weatherproof jackets), apply sunscreen or other protection if attending on sunny days, and assess your health suitability for an outdoor experience (e.g., allergies to pollen, sensitivity to heat or cold). As a public venue, Fed Square carries inherent risks of illness (e.g., colds, viruses) or minor disruptions (e.g., noise from passersby). We are not liable for such occurrences, to the extent permitted by law. We are not responsible for hearing damage from ambient noise, injuries from failing to follow staff instructions (e.g., tripping over cords), or other incidents arising from guest negligence or external factors, unless directly caused by our actions.

7.2 Limitation of Liability

Fondue Chalet, its staff, affiliates, and BBR Group Australia are not liable for any injury, loss, or damage to you or your property, except where caused by our direct negligence or breach of Australian Consumer Law guarantees (e.g., failure to provide services with due care). You agree to indemnify us against any losses, damages, or liabilities we incur due to your wilful, reckless, or negligent behaviour during the event (e.g., damaging equipment, causing injury to others).

8. Photography and Media

By attending, you consent to being photographed, filmed, or recorded by Fondue Chalet or Fed Square representatives for promotional purposes (e.g., social media, brochures). No compensation is provided, and usage rights are unlimited. To opt out, inform staff upon arrival or email us beforehand at info@fonduechalet.com.au. You may take photos or videos for personal, non-commercial use. Professional or commercial photography (e.g., with tripods, large lenses) requires prior written approval from Fondue Chalet management. Unauthorised commercial use may result in removal or legal action.
